This policy (together with our terms of use Terms and Conditions and any other documents referred to on it) applies to this specific website www.bartinstruments.com ("our site"), and sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

For the purposes of the Data Protection Act 1998 (the "Act"), the data controller is b:art instruments. 

We inform customers that the online store software provider Shopify, based in Canada, may store customer data outside the European Economic Area, but the data will only be transferred to countries that provide an adequate degree of protection based on a decision of the European Commission, and to countries that do not provide an adequate degree of protection only if adequate safeguards are provided, including but not limited to standard contractual clauses adopted by the European Commission or binding corporate rules.

We may collect and process the following personal information about you:
Information that you provide by filling in forms on our site. This includes information provided at the time of registering to use our site, subscribing to our service, posting material or requesting further services. We may also ask you for information when you enter a competition or promotion sponsored by b:art instruments, and when you report a problem with our site;

ACCESS TO INFORMATION

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act. Any access request may be subject to a fee of EUR10 to meet our costs in providing you with details of the information we hold about you.

 

PROCESSING AND PROTECTION OF PERSONAL DATA

  1. The CUSTOMER'S Personal Data Administrator processed in connection with the use of the ONLINE STORE is SELLER.
  2. Providing personal data, as well as consent to their processing are completely voluntary. All personal data provided to us are processed only to the extent and purpose for which the CUSTOMER agreed. In the event that the CUSTOMER does not provide the data necessary to fulfill the order and does not agree to their processing, it may not be possible to complete the order.
  3. The administrator ensures the security of the transferred data and the implementation of CUSTOMER's rights resulting from the RODO Regulation.
  4. The CLIENT has the right to access their personal data and rectify their request to completely remove or limit the right to process their personal data, the right to object to processing - for this purpose you can use the function in the user account store update program or submit a report ( e.g. to the e-mail address provided), specifying the request for changes or deletion of data from the records. The customer has the right to withdraw his consent at any time.
  5. The CLIENT has the right to receive data regarding a structured, commonly used machine-readable format. He also has the right to send this data to another administrator, without any obstacles on the part of the ADMINISTRATOR from which the data will be extracted (Article 20 (1)). In cases where it is technically possible, the CLIENT may request the ADMINISTRATOR to forward its data directly to another administrator (Article 20 (2)).
  6. The ADMINISTRATOR may refuse to delete the CUSTOMER's data only in cases specified by applicable law, in particular if the CLIENT has not paid all amounts due to the ADMINISTRATOR.
  7. To perform the contract service, it is necessary to provide the following CONSUMER data:
  • surname and name,
  • address for shipping products,
  • e-mail adress,
  • telephone number,
  • in the case of the company, the company name and tax identification number.

    8. All personal data provided during the ordering process is used only to form, conclude, change or terminate the Contract between the SERVICE PROVIDER and the CLIENT and fulfill the Contract of Sale or contract for the provision of electronic service or order fulfillment and are not made available to other institutions or third parties - except those described in point .6.

    9.In the case of the sale of products via the ONLINE STORE in order to deliver products to the CLIENT, personal data necessary to address and deliver the parcel are provided to companies professionally involved in the delivery of parcels - in particular Poczta Polska and courier companies - together with entrusting the shipment to be delivered.

   10. Personal data is processed only for the period necessary to perform the contract or the purpose for which the consent was granted.

We will process this data as long as the User does not terminate the concluded contract or until the time of possible claims expiration;

- data in sales documents - for the period required by the accounting regulations;

- e-mail address used to send an information bulletin - for the period of validity of the user's consent. Consent can be withdrawn at any time;

- address data used to send marketing information about the Administrator's own services - (the basis of the processing is a legitimate interest of the Administrator - Article 6 (1) letter f of the RODO). We will process this data for as long as the User does not object to the processing of data for this purpose.

Shipping & Returns

 

Overview

The price of any Goods will be as quoted on our site from time to time, except in cases of obvious error.

All prices are in Euro (EUR), which is the accepted currency.

 

1. Order Processing

  • Processing Time: Orders are processed within 1-5 business days (Monday through Friday, excluding holidays).
  • Custom Orders: Custom-built or personalised modules may require additional processing time. We will provide you with an estimated shipping date when you place your order.

Please note that we cannot be held responsible for delays caused directly by customs clearance or carrier processing issues, which may include weather-related delays, mechanical issues, packages marked as undeliverable, or address problems. However, we commit to shipping your orders as soon as possible, even in the event of temporary suspensions of shipping services.

Please note that in case of any unexpected circumstances preventing us from shipping goods on time, we reserve the right to withhold refund process until shipping issues have been resolved. At the same time, we oblige to ship the orders within the nearest date possible in case any temporary suspensions of shipping services take place.

 

2. Shipping Methods and Rates

  • Within the EU: All our products are shipped with UPS Standard or Poczta Polska, free of charge.
  • Outside the EU: All our products are shipped with DHL Express, and we charge a shipping fee for orders below 200EUR. Shipping costs will be calculated when you place your order. For orders outside European Union duties and taxes may be charged. The client is responsible for covering the duties and/or taxes, which depend on the local government. If these payments are not met on delivery, the item doesn’t clear customs or if the item is not withdrawn for any reason, the item will be sent back to us or destroyed, depending on local laws return fees and import taxes will be deducted from the clients. Refunds will not be given in these cases, depending on the case - store credit may be given to the client.

 

3. Price Changes

Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

 

4. Shipping Address

Please ensure that your shipping address is correct and complete. We are not responsible for orders shipped to incorrect or incomplete addresses provided by you. If you realise there is an error in your shipping address, please contact us immediately via the contact page.

 

5. Lost or Damaged Packages

In the unlikely event that your package is lost or damaged during transit, please contact us as soon as possible. We will work with the shipping carrier to resolve the issue and ensure you receive a replacement or refund.

Once an order is shipped, if the customer refuses reception of the delivery, the package will be abandoned and no refund will be given.

 

6. PO Boxes

The delivery address must match the billing address. We do not deliver to P.O boxes.

 

7. Additional Information

Our site contains a large number of Goods and it is always possible that, despite our best efforts, some of the Goods listed on our site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where the correct price of the Goods is less than our stated price, we will charge the lower amount when dispatching the Goods to you. If the correct price of the Goods is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the Goods, or reject your order and notify you of such rejection.

We are under no obligation to provide the Goods to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.

Payment for all Goods must be paid via Paypal, payment cards via eCard (Visa, Visa Electron, Master Card, Master Card Electronic, Maestro) or wire transfer. We will not dispatch your order until payment for the goods is received in full.

Return Policy

We understand that sometimes things don't work out as planned, and we're here to help make your return process as smooth as possible.

 

1. Return Eligibility

You can return any item within 30 days of purchase, provided it is in its original condition. This means the product must be unused, undamaged, and in its original packaging.

 

2. Return Process

After contacting us through our CONTACT page, you will be provided with a unique Return Merchandise Authorisation (RMA) number and instructions on how to return the product. Package your item securely, including all original packaging and accessories. Write the RMA number on the outside of your package and ship it to the address provided by our support team.

 

3. Refunds

Once we receive and inspect your returned item, we will notify you via email. If your return is approved, we will process your refund to your original payment method within 5-7 business days. Please note that shipping costs are non-refundable.

 

4. Exchanges

If you wish to exchange your item for a different product, please use the same contact form as above. We’ll accommodate any exchange requests similarly to how we process refunds.

 

5. Damaged or Defective Items

If you receive a damaged or defective item, please contact us immediately. We will arrange for a replacement or refund at no additional cost to you. Please provide photos of the damage or defect to expedite the process.

Under the Waste Electrical and Electronic Equipment (WEEE) Regulations, we are committed to reducing the environmental impact of our products. You can return your old electronic equipment to us for recycling when you purchase a new product from us. Please contact customer service for details on how to return your used electronics.

You agree to indemnify, defend and hold harmless b:art instruments and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
